1. Definitions 

1.1 "Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller.

1.2 "Consumer" shall have the meaning ascribed in section 2 of the Consumer Rights Act 2015.

1.3 "Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms & Conditions. 

1.4 "Goods" means the creative designs and products (including any digital content) that the Buyer agrees to buy from the Seller.

1.5 "Seller" means BoWa who owns and operates BoWa.

1.6 "Terms & Conditions" means the terms and conditions of sale set out in this agreement and any special terms and conditions agreed in writing by the Seller. 

1.7 "Website" means BoWa’s domain name.

2. Accepting these terms 

2.1 Your access to and use of BoWa, its creative designs and products is subject exclusively to these Terms & Conditions. You will not use the BoWa brand, its creative designs and products for any purpose that is unlawful or prohibited by these Terms & Conditions. By using the website, BoWa, its creative design and products, you are fully accepting the terms, conditions and disclaimers contained in this notice. 

2.2 If you do not accept these Terms & Conditions, you must immediately stop using the website. 

2.2 Nothing in these Terms & Conditions shall affect your statutory rights as a Consumer. 

2.3 These Terms & Conditions shall apply to all contracts for the sale of Goods by BoWa to you and shall prevail over any other documentation or communication from you. 

2.4 Acceptance of delivery of the Goods shall be deemed conclusive evidence of your acceptance of these Terms & Conditions. 

2.5 Any variation to these Terms & Conditions (including any special terms and conditions agreed between us) shall be inapplicable unless agreed in writing by BoWa.

3. When you place an order 

3.1 All orders for Goods shall be deemed to be an offer by you to purchase Goods pursuant to these Terms & Conditions and are subject to acceptance by BoWa. BoWa may choose not to accept an order for any reason. 

3.2 To order Goods from this website, you must legally hold a valid credit / debit card or hold a valid PayPal account. 

3.3 Where the items ordered are not available from stock you will be notified and given the option to either wait until the item are available from stock or cancel the order and receive a full refund within 14 days. 

3.4 For commissioned or personalised items, BoWa will discuss details and requirements with you via email at bowa.design@gmail.com. The item will not be made until both you and BoWa have agreed the requirements. A timescale will be advised at this stage of the order. 

3.5 For these commissioned or personalised items, BoWa will begin working on the Goods 48 hours after payment has been received. See the Cancellation section for more information. 

3.6 Title in the items shall not pass to you until payment of the price has been made in full. Please be aware that the copyright of the item remains with BoWa. 
 

4. Description of items and product variations  

4.1 The visual representations of Goods on the website are as accurate as possible. Any items that are handmade may vary slightly to the photo on the website. BoWa endeavours to match colour and print as closely as possible. However different monitors vary and BoWa cannot guarantee the accuracy of colours on our website or what you, in turn, will see on your monitor. 

4.2 All item sizing will be within the product description in the shop page of the website. 

5. Price and payments 

5.1 The price of the items shall be that stipulated on the website. 

5.2 The total purchase price, including delivery and other BoWa charges, if any, will be confirmed prior to the order being accepted. 

5.3 After the order is received BoWa will confirm by email the details, description and price for the items. 

5.4 Payment of the price and delivery charges must be made in full before dispatch of the items. 

5.5 As the buyer, you have two options for payment on this website: 

• PayPal: If choosing PayPal, you are required to have a valid PayPal account. 

• Square: You can pay either by valid credit card or debit card through this method.  

 5.6 For commissioned goods, once the details have been agreed, full payment must be made before the order can be accepted.  A payment request will be sent to you, with delivery charges included. 

5.7 Your order will be shipped after the payment has been processed and reaches BoWa’s bank account. 

6. Cancellation 

6.1 For non commissioned or personalised items, you can cancel your order up to and no later than 3 working days after the Goods have been purchased. After this time, the Goods will be dispatched to you, please see our Returns Policy for more information.

6.2 For commissioned and personalised items, you can cancel your order up to and no later than 48 hours after payment has been received.  

7. Rights of Seller 

7.1 BoWa reserves the right to periodically update prices on the website, which cannot be guaranteed for any period of time. BoWa shall make every effort to ensure prices are correct at the point at which you place an order. 

7.2 BoWa reserves the right to withdraw any items from the website at any time. 

7.3 BoWa shall not be liable to anyone for withdrawing any items from the website or for refusing to process an order.
